face="宋体">10月29日，徐闻县公安局严密部署2020年第三轮集中清查收缴非法枪爆物品专项行动后，五里派出所长杨远吟组织全所民警、辅警召开会议，解读方案，分解任务，将民警、辅警分组深入辖区村委会宣传发动，真正将警力下沉至群众中收集线索。10月30日，杨远吟所长带队在南山镇南某村开展枪支清缴宣传工作时，村委会干部反映<strong><span style='color: rgb(255, 76, 0);'>该村在90年代初组织护村联防队时，曾向湛江市保安公司购买过一批枪支弹药，但是一直都没有使用过，由于闲置时间太久了，大家都忘记了这批枪支和子弹的存在。</span></strong>杨远吟所长马上将此情况向县局汇报，该局党委高度重视，要求五里派出所立即组织民警开展收缴工作。<strong>经现场清点，共收缴制式猎枪2支，电击式手枪3支，猎枪弹12发。</strong></font></section><section face="宋体">2、《最高人民法院关于审理非法制造、买卖、运输枪支、弹药、爆炸物等刑事案件具体应用法律若干问题的解释》第五条具有下列情形之一的，依照刑法第一百二十八条第一款的规定，以非法持有、私藏枪支、弹药罪定罪处罚：</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(一)非法持有、私藏军用枪支一支的;</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(二)非法持有、私藏以火药为动力发射枪弹的非军用枪支一支或者以压缩气体等为动力的其它非军用枪支二支以上的;</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(三)非法持有、私藏军用子弹二十发以上，气枪铅弹一千发以上或者其它非军用子弹二百发以上的;</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(四)非法持有、私藏手榴弹一枚以上的;</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(五)非法持有、私藏的弹药造成人员伤亡、财产损失的。</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">具有下列情形之一的，属于刑法第一百二十八条第一款规定的“情节严重”：</font></p><p style='text-indent: 2em;line-height: 1.75em;'><font size="3" face="宋体">(一)非法持有、私藏军用枪支二支以上的;</font></p><p
